1. Acceptance of Terms
By accessing and using NFTMarket ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and NFTMarket AG.
2. Eligibility
To use the Platform, you must be at least 18 years of age and have the legal capacity to enter into these Terms. By using the Platform, you represent and warrant that you meet these eligibility requirements.
3. Platform Description
NFTMarket is a curated marketplace for digital art as non-fungible tokens (NFTs) on the Ethereum blockchain. We facilitate the sale of digital art between artists and collectors. NFTMarket acts as a platform provider and does not take custody of any digital assets.
4. Account and Wallet
To make purchases on the Platform, you need an Ethereum-compatible wallet. You are solely responsible for:
- Maintaining the security of your wallet and private keys
- All activities conducted through your wallet on our Platform
- Ensuring you have sufficient ETH to complete transactions
5. Purchasing NFTs
5.1 Purchase Process
To purchase an NFT, you must send the exact listed ETH amount to the designated wallet address. After sending payment, you must submit your transaction hash and receiving wallet address to complete the purchase.
5.2 Pricing
All prices are listed in ETH (Ethereum). Prices may change without notice. The price at the time of your transaction submission is the final price.
5.3 No Refunds
All sales are final. Due to the nature of blockchain transactions, refunds are not possible once a transaction has been confirmed on the Ethereum network. Please review your purchase carefully before completing a transaction.
6. Intellectual Property
6.1 Platform Content
All content on the Platform, including text, graphics, logos, and software, is owned by NFTMarket AG and is protected by intellectual property laws.
6.2 NFT Ownership
Purchasing an NFT grants you ownership of the digital token. You receive a non-exclusive license to display the associated artwork for personal, non-commercial purposes. Copyright and intellectual property rights of the artwork remain with the original artist unless explicitly transferred.
7. Prohibited Activities
You agree not to:
- Use the Platform for money laundering or terrorist financing
- Manipulate or attempt to manipulate the market for any NFT
- Use bots, scripts, or automated tools to interact with the Platform
- Circumvent any security measures on the Platform
- Infringe on any third-party intellectual property rights
- Use the Platform for any unlawful purpose
8. Risks
You acknowledge the following risks associated with NFT transactions:
- Cryptocurrency and NFT values are highly volatile
- Blockchain transactions are irreversible
- Regulatory changes may affect the NFT market
- Smart contracts may contain unforeseen vulnerabilities
- Loss of wallet access results in permanent loss of assets
9. Limitation of Liability
To the maximum extent permitted by law, NFTMarket AG shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
10. Indemnification
You agree to indemnify and hold harmless NFTMarket AG, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
11. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
12. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Platform.
13. Governing Law
These Terms are governed by the laws of Switzerland. Disputes shall be resolved in the courts of Zurich, Switzerland.
